Terms & Conditions — Contract
These Terms are a contract between you and Tournado Private Limited. They govern your use of the Tournado app, websites, services, products, and content (collectively, the "Services"). By using Tournado, you agree to these Terms. If you don't agree, you can't use Tournado. We may change these Terms at any time; by using Tournado on or after the effective date, you agree to the new Terms.
Content rights & responsibilities
By scoring matches and tournaments on Tournado, you grant us a non-exclusive license to publish them on the Tournado platform (website, apps, etc.) and to do things reasonably related to publishing (storing, displaying, reformatting, aggregating, distributing). In consideration for access and use of the platform, you agree that Tournado may enable advertising on the platform, including in connection with display of your content or other information. We may also use your content to promote Tournado and sell premium features by aggregating, normalising and enriching your scores.
Our content and services
We reserve all rights in Tournado's look and feel. Some parts of Tournado are licensed under third-party open-source licenses; we also make some of our own code available under open-source licenses. Except where permitted by law or express written permission from Tournado, you may not copy or adapt any portion of our code or visual design elements (including logos).
Acceptable & prohibited use
- Do not access or tamper with non-public areas of the Services, our systems, or our providers' systems.
- Use only published interfaces (e.g., APIs) to access or search the Services.
- Do not forge headers or use the Services to send altered, deceptive, or false source-identifying information.
- Do not interfere with or disrupt the access of any user, host, or network (e.g., sending a virus, overloading, flooding, spamming, mail-bombing, or scripting content/account creation in a way that burdens the Services).
Crawling & scraping
Crawling the Services is allowed if done in accordance with the provisions of our robots.txt file, but scraping the Services is prohibited.
Changes, termination, or restrictions
We may change, terminate, or restrict access to any aspect of the Services, at any time, without notice.
Incorporated rules & policies
By using the Services, you agree to let Tournado collect and use information as detailed in our Privacy Policy. If you're outside the Republic of India, you consent to letting Tournado transfer, store, and process your information (including personal information and content) in and out of the Republic of India. By using Tournado, you agree to follow these rules and policies. If you don't, we may remove content, or suspend or delete your account.
Miscellaneous
Disclaimer of warranty
Tournado provides the Services to you as is. You use them at your own risk and discretion. No warranties (express or implied), including merchantability, fitness for a particular purpose, availability, security, title, or non-infringement.
Limitation of liability
Tournado won't be liable to you for any damages that arise from your using the Services, including if the Services are hacked or unavailable. This includes indirect, incidental, consequential, special, or exemplary damages, and all kinds of legal claims (breach of contract/warranty, tort, or other loss).
No waiver
If Tournado doesn't exercise a particular right under these Terms, that doesn't waive it.
Severability
If any provision of these Terms is found invalid by a court of competent jurisdiction, the court should try to give effect to the parties' intentions as reflected in the provision; the remaining provisions remain in full effect.
Choice of law & jurisdiction
These Terms are governed by Indian law, without reference to its conflict of laws provisions. Any suit arising from the Services must take place in a court located in Mumbai, Maharashtra.
Entire agreement
These Terms (including any document incorporated by reference) are the whole agreement between Tournado and you concerning the Services.
